Use of the Site
Both the Site and Terratory Journal Content are intended for customers of Terratory. You may not use the Site or Terratory Journal Content for any purpose not related to your business with Terratory Journal. You are specifically prohibited from: (a) downloading, copying, or re-transmitting any or all of the Site or Terratory Journal Content without, or in violation of, a written license or agreement with Terratory Journal or the relevant copyright holders displayed on the Site; (b) using any data mining, robots or similar data gathering or extraction methods; (c) manipulating or otherwise displaying the Site or the Terratory Journal Content by using or framing similar navigational technology; (d) registering, subscribing, unsubscribing, or attempting to register, subscribe, or unsubscribe any party for any Terratory Journal product or service if you are not expressly authorized by such party to do so; (e) reverse engineering, altering or modifying any part of the Site or the Terratory Journal Content; (f) circumventing, disabling or otherwise interfering with security-related features of the Site or any system resources, services or networks connected to or accessible through the Site; (g) selling, licensing, leasing, or in any way commercializing the Site or the Terratory Journal Content without specific written authorization from Terratory or the copyright holders, and (h) using the Site or the Terratory Journal Content other than for its intended purpose. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws, the laws of privacy and publicity, and applicable communications regulations and statutes. You represent and warrant that you will comply with all applicable laws and regulations, including, without limitation, those relating to the Internet, data, e-mail, privacy, and the transmission of technical data exported from the United States or the country in which you reside.
Copyright Infringement Policy
Terratory uses state of the art technology to track Terratory Journal and Site content online. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, Terratory has adopted a policy of terminating, in appropriate circumstances and at Terratory’s sole discretion, account holders who infringe the intellectual property rights of Terratory Journal or any third party participants in Terratory Journal. In the vent of infringement, Terratory reserves the right to serve cease and desist notices and to take legal action on all parties who infringe copyright and trademark laws as defined by the DMCA.
The Terratory Journal logo, and any other product or service names or slogans contained in the Site are trademarks of Terratory and its suppliers or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Terratory or the applicable trademark holder. You may not use metatags or any other "hidden text" utilizing "Terratory Journal”, “Terratory” or any other name, trademark, or product or service name of Terratory or Terratory Journal without our prior written permission. In addition, the look and feel of the Site, including all page headers, custom graphics, button icons and scripts, are the service mark, trademark and/or trade dress of Terratory and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other images, trademarks, registered trademarks, product names and company names or logos mentioned in the Site are the property of their respective owners. Reference to any people, products, services, processes or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by us.
Forums & Other Interactive Services or Areas
The Site may include discussion forums or other interactive areas or services, including blogs, message boards, or other areas or services in which you or third parties create, post or store content, messages, comments, materials or other items on the Site ("Interactive Areas"). You are solely responsible for your use of such Interactive Areas and use them at your own risk. By using any Interactive Areas, you agree not to post, upload, transmit, distribute, store, create or otherwise publish through the Site any of the following:
· Any message, comment, data, information, text, music, sound, photos, graphics, code or other material ("User Content") that is unlawful, libelous, defamatory, obscene, pornographic, harmful to minors, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
· User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
· User Content that may infringe any patent, trademark, trade secret, copyright or other intellectual property or contract right of any party. By posting any User Content, you represent and warrant that you have the lawful right to transmit, distribute and reproduce such User Content;
· User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
· Unsolicited promotions, political campaigning, advertising, junk mail, spam, chain letters, pyramid schemes or solicitations;
· Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
· Viruses, corrupted data, or other harmful, disruptive or destructive files; and
· User Content that, in the sole judgment of Terratory, is objectionable, or that restricts or inhibits any other person from using or enjoying the Interactive Areas of the Site, or which adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all capital letters, or flooding continuous posting of repetitive text), or which may expose Terratory Journal or its users to any harm or liability of any type.
Personal Identification Information
We may collect personal identification information from Site Users in a variety of ways, including, but not limited to; when Users visit our Site, register on the Site, place an order, subscribe to the journal, respond to a survey, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, credit card information. Users may, however, visit our Site anonymously. We will collect personal identification information from Users, only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
Non-personal Identification Information
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.
How We Use Collected Information
By subscribing to Terratory Journal on the Site, Users opt-in to our mailing list and could receive emails that may include company links to new journal articles and issues, news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, Terratory will include detailed unsubscribe instructions at the bottom of each email or the User may contact us via our Site. Your contact information may be used to respond to inquiries, questions, and/or other requests. Terratory may collect and employ Users personal information for the following purposes:
· We may use the information Users provide when placing an order to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
· To run a promotion, contest, survey or other Site feature.
· To send Users information they agreed to receive about topics we think will be of interest to them.
· To send periodic emails.
· To process payments.
How We Protect Your Information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures. When an automatic payment is completed on a subscription, an order is generated to keep a record of the payment, securely.
Sharing Your Personal Information
We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may also use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.
Users could find advertising or other content on our Site that links to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, are subject to that website’s own terms and policies.
Changes to Site Terms
Terratory reserves the right to change any of the terms and conditions contained in the Site Terms or any policy or guideline of the Site, at any time and in its sole discretion. When we make changes, we will revise the "last updated" date at the bottom of the Site Terms. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site, following the posting of changes, will constitute your acceptance of such changes. We encourage you to review the Site Terms whenever you visit our website.
Your Acceptance of these Terms
By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
Notwithstanding any of these Site terms, Terratory reserves the right, without notice and in its sole discretion, to terminate your account and/or to block your use of the Site.
You agree to defend, indemnify and hold harmless Terratory, Terratory Journal, its subsidiaries, affiliates, licensors, employees, agents, third party information providers and independent contractors against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to any User Content that you post, store or otherwise transmit on or through the Site, your conduct, your use or inability to use the Site, your breach or alleged breach of the Site Terms or of any representation or warranty contained herein, your unauthorized use of Terratory Journal Content, or your violation of any rights of another.
Applicable Law and Venue
Any dispute relating in any way to use of the Site or the Terratory Journal Content shall be submitted to confidential arbitration in Portland, Oregon, except that, to the extent you have in any manner violated or threatened to violate Terratory’s intellectual property rights. Terratory may seek injunctive or other appropriate relief in any state or federal court in the State of Oregon, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this provision shall be conducted, by a single arbitrator, under the prevailing rules as defined by the American Arbitration Provision. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to the Site Terms, whether through class arbitration proceedings or otherwise.
